Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the TrainBetter.Coach platform, including our website at trainbetter.coach, our mobile applications, and all related services (collectively, the "Platform"). The Platform is operated by TrainBetter ("we," "us," or "our").

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Platform.

2. Beta Disclaimer

The Platform is currently in a beta testing phase. During the beta period:

  • Features may be incomplete, unstable, or subject to change without notice.
  • Data loss, service interruptions, and unexpected behavior may occur.
  • We may modify, suspend, or discontinue any feature at any time.
  • Subscription pricing, feature availability, and tier structures are subject to change.
  • We appreciate your feedback and patience as we refine the Platform.
THE PLATFORM IS PROVIDED DURING BETA ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES REGARDING THE RELIABILITY, AVAILABILITY, OR COMPLETENESS OF THE PLATFORM DURING THE BETA PERIOD.

3. Eligibility

You must be at least 16 years old to create an account and use the Platform. By creating an account, you represent that you are at least 16 years old and that you have the legal capacity to enter into these Terms. If you are between the ages of 16 and 18 (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

4. Account Registration and Security

4.1 Account Creation

To use the Platform, you must create an account using a valid email address and password, or through a supported authentication provider (Google, Apple). You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@trainbetter.coach if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to maintain account security.

4.3 One Account Per Role

Each account is associated with a single role: Athlete or Coach. If you are both a coach and a practicing athlete, you must maintain separate accounts for each role. You may link these accounts through the Platform's linked accounts feature.

5. User Roles and Responsibilities

5.1 Athlete Accounts

Athlete accounts provide access to training data synchronization, AI-generated insights, and the ability to accept coaching relationships. Athletes control which third-party services are connected and can disconnect them at any time. Athletes may accept or decline coach invitations and may end coaching relationships at any time.

5.2 Coach Accounts

Coach accounts are available by application and are subject to approval during the beta period. Coach accounts include all Athlete features plus roster management, coaching notes, training plan creation, athlete invitation capabilities, and assistant coach management. By applying for a Coach account, you represent that you have legitimate coaching experience or credentials as described in your application. We reserve the right to approve, reject, or revoke Coach account status at our discretion.

5.3 Assistant Coaches

Coaches may grant assistant coach access to members of their coaching team. Assistant coaches receive permissions defined by the primary coach (which may include viewing athlete data, adding coaching notes, or managing invitations). The primary coach is responsible for the actions of their assistant coaches on the Platform.

6. Third-Party Integrations

6.1 Connecting Services

The Platform connects to third-party fitness and health services including Strava, Whoop, Garmin, and TrainingPeaks. When you authorize a connection, you grant TrainBetter permission to access and import data within the scopes defined during the authorization process.

6.2 Third-Party Terms

Your use of third-party services is governed by their respective terms of service and privacy policies. TrainBetter is not responsible for the availability, accuracy, or policies of third-party services. If a third-party service modifies its API, changes its terms, or becomes unavailable, features of the Platform that depend on that service may be affected.

6.3 Data Accuracy

We import data from third-party services as provided by their APIs. We do not guarantee the accuracy, completeness, or timeliness of data imported from third-party services. Discrepancies between data shown on the Platform and data shown on the original service should be reported to support@trainbetter.coach.

7. AI-Generated Content

7.1 Nature of AI Insights

The Platform uses artificial intelligence (powered by OpenAI) to analyze your training and recovery data and generate insights, recommendations, and summaries. These AI-generated outputs are informational tools designed to support — not replace — the judgment of athletes and coaches.

7.2 Not Medical or Professional Advice

AI-GENERATED INSIGHTS ARE NOT MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT RECOMMENDATIONS. The Platform is not a healthcare provider and does not provide medical services. AI-generated insights regarding recovery, training load, injury risk, or physiological metrics are based on data analysis and pattern recognition, not clinical evaluation.

You should always consult with a qualified healthcare professional before making decisions about your health, especially regarding injury, illness, or physiological concerns flagged by the Platform.

7.3 No Guarantee of Accuracy

AI-generated insights may be inaccurate, incomplete, or inappropriate for your specific circumstances. We do not guarantee the accuracy, reliability, or suitability of any AI-generated content. You use AI-generated insights at your own risk and discretion.

7.4 Coach Review

Some AI-generated insights may be reviewed, annotated, or endorsed by a coach. Coach annotations represent the coach's professional opinion and do not constitute an endorsement or warranty by TrainBetter.

8. Coach-Athlete Relationships

8.1 Independent Relationships

Coaches who use the Platform are independent professionals, not employees, agents, or representatives of TrainBetter. The coaching relationship is between the coach and the athlete. TrainBetter provides the technology platform but is not a party to any coaching agreement, and we are not responsible for the quality, safety, or outcomes of coaching services.

8.2 Invitation and Consent

Coaching relationships on the Platform are initiated by coach invitation and require athlete consent. Either party may end the relationship at any time through the Platform.

8.3 Data Access in Coaching Relationships

When an athlete accepts a coaching relationship, the coach gains read access to the athlete's training data, AI insights, and shared coaching notes. This access is governed by our Privacy Policy. Athletes should review Section 4.2 of the Privacy Policy before accepting a coaching relationship.

9. Subscriptions and Payments

9.1 Subscription Plans

Access to certain Platform features requires a paid subscription. Current subscription tiers, pricing, and included features are described on our pricing page. Subscription pricing and features are subject to change; we will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

9.2 Billing

Subscriptions are billed in advance on a monthly or annual basis through Stripe. By subscribing, you authorize us to charge your designated payment method at the applicable rate until you cancel. Annual subscriptions are charged in full at the time of purchase.

9.3 Cancellation

You may cancel your subscription at any time through the Stripe Customer Portal or by contacting support@trainbetter.coach. Upon cancellation, your subscription remains active through the end of the current billing period. We do not provide prorated refunds for partial billing periods.

9.4 Coach-to-Athlete Billing

Coaches may bill their athletes through the Platform using Stripe Connect for services including monthly retainers, per-session charges, and package deals. These transactions are between the coach and the athlete. TrainBetter facilitates the payment processing and may charge a platform fee on transactions as described on our pricing page. TrainBetter is not responsible for disputes between coaches and athletes regarding coaching services or payments.

9.5 Refund Policy

Subscription refunds are handled on a case-by-case basis. Requests for refunds should be directed to support@trainbetter.coach. For coach-to-athlete payments, refund requests should be directed to the coach. TrainBetter may facilitate refunds through the Platform but is not obligated to do so.

10. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Attempt to gain unauthorized access to any part of the Platform, other user accounts, or any systems or networks connected to the Platform.
  • Use automated scripts, bots, or other tools to access the Platform, scrape data, or circumvent usage limits, unless authorized through our API (available to Enterprise tier subscribers).
  • Interfere with or disrupt the Platform's infrastructure, performance, or availability.
  • Upload, transmit, or share content that is defamatory, obscene, threatening, or otherwise objectionable.
  • Use data obtained through the Platform to contact, advertise to, or solicit athletes or coaches outside the context of an established Platform relationship.
  • Share your account credentials with third parties.
  • Reverse engineer, decompile, or disassemble any part of the Platform.
  • Use the Platform to develop a competing product or service.

We reserve the right to suspend or terminate your account for violations of these Terms, with or without notice.

11. Intellectual Property

11.1 Platform Ownership

The Platform, including its design, code, features, algorithms, AI models and prompts, branding, documentation, and all associated intellectual property, is owned by TrainBetter and is protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in the Platform.

11.2 Your Data

You retain ownership of the personal data and training data you provide to or import into the Platform. By using the Platform, you grant TrainBetter a non-exclusive, worldwide, royalty-free license to use, process, and store your data solely for the purposes of providing and improving the Platform's services as described in these Terms and our Privacy Policy.

11.3 Coach-Created Content

Coaches retain ownership of coaching notes, training plans, and other original content they create on the Platform. By creating content on the Platform, coaches grant TrainBetter a non-exclusive license to store, display, and transmit that content as necessary to operate the Platform (e.g., displaying training plans to assigned athletes).

11.4 Feedback

If you provide suggestions, ideas, or feedback about the Platform, you grant TrainBetter a perpetual, irrevocable, royalty-free license to use and incorporate that feedback for any purpose without obligation to you.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRAINBETTER, ITS FOUNDER, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TRAINBETTER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

14. Indemnification

You agree to indemnify, defend, and hold harmless TrainBetter and its founder, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or related to your use of the Platform, violation of these Terms, or violation of any third-party rights.

15. Account Suspension and Termination

You may close your account at any time by contacting support@trainbetter.coach or through your account settings. We may suspend or terminate your account at any time, with or without cause and with or without notice. Upon termination, we will process your data in accordance with our Privacy Policy.

16. Modifications to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes your acceptance.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

Any dispute shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, either party may pursue binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in the State of Georgia.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

18. General Provisions

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TrainBetter regarding the Platform and supersede all prior agreements and understandings. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
